Jammu and Kashmir enjoyed special status under Article 370 of the Constitution of India. This Article describes it as a temporary provision and that it will cease to be operative if the President issues a public notification to that effect. However, prior to that, a recommendation is necessary from the Constituent Assembly of Jammu and Kashmir.As a result of Article 370, Jammu and Kashmir had its own Constitution, and all laws passed by Parliament will not be applicable to the State, unless the State government gives its concurrence. The President is empowered to decide what provisions of the Constitution of India would be applicable to the State and what are the exceptions, but with the State government’s concurrence.The Constitution (Application to Jammu and Kashmir) Order, 1954, lists the Articles and provisions that apply to J&K. Further, the President also listed a set of exceptions under Article 35A of the Constitution (this Article does not figure in the text of the Constitution of India, but figures only in the J&K’s Constitution). While the 1954 presidential order constituted a founding legal document for Jammu and Kashmir, Article 35A protected the exclusive laws – such as the bar on outsiders buying property and women marrying non-Kashmiris losing their property rights – of the State.These special measures can be altered only on the recommendation of the Sadar-i-Riyasat of Jammu and Kashmir, acting on the advice of the Council of Ministers, or by the “Constituent Assembly” of that State. As of now, there is no “Constituent Assembly”.This is how the Modi government changed Kashmir’s special status overnight:1. President Ram Nath Kovind issued a presidential order under Article 370 (1) of the Constitution. This clause enables the President to specify the matters which are applicable to Jammu and Kashmir. As it can be issued only with the Jammu and Kashmir government’s concurrence, the notification uses the words “with the concurrence of the Government of the State of Jammu and Kashmir”. This presumably means the Governor, who is now administering the State under President’s Rule, has given his concurrence on behalf of the State government.2. The Order supersedes the 1954 Order. This effectively means that all the provisions that formed the basis of a separate “Constitution” for Jammu and Kashmir stand abrogated. The Order declares that all the provisions of the Constitution of India, shall apply to Jammu and Kashmir too.3. However, some special measures were still needed for the scrapping of Article 370 altogether. Therefore, a few clauses were added to Article 367 of the Constitution.Article 367 contains “Interpretations”. They contain guidance on how to read or interpret some provisions. The new clauses say, when applicable to Jammu and Kashmir, all references to the ‘Sadar-i-Riyasat’, acting on the aid and advice of the Council of Ministers, will be construed as references to the Governor of Jammu and Kashmir. All references to the State government shall mean “the Governor”.And most importantly, the reference to the “Constituent Assembly” in a proviso to Article 370 (3) has been amended to read “Legislative Assembly of the State”. This is the proviso that says the President can declare that Article 370 is no more operative only on the recommendation of the Constituent Assembly. As there is no Constituent Assembly in existence now, there is no body to “recommend” the demise of Article 370. Therefore, the State Assembly has to play that role.The issuance of the Presidential Order has set the stage for the abrogation of Article 370. Here, the government has made use of the fact that Jammu and Kashmir is under President’s Rule. Under the Proclamation issued under Article 356 of the Constitution, by which the President takes over the administration of a State, Parliament usually performs the legislative functions of the State Assembly. For instance, when a State is under Central rule, the budget allocations for that State are voted in Parliament in the absence of the Assembly.The Union Home Minister introduced two statutory resolutions, one, to recommend that the President issue a notification rendering Article 370 inoperative, and two, to accept the Jammu and Kashmir Reorganisation Bill. The passage of the former resolution will enable the President to declare that Article 370 has ceased to operate.The Bill envisages converting Jammu and Kashmir into a Union Territory with a legislature, and carve out Ladakh region as another Union Territory, but without a legislature.

By BEN HARRIS1. Touch football tournaments and rain are a match made in heaven:It’s probably something we already know but if you want rain, hold a touch football tournament. I would not be surprised if there was a touch football comp held in the middle of the Sahara Desert, it would rain cats and dogs. The torrential rain we saw for the men’s open match was incredible. In 15 minutes, the field turned into a swimming pool. It brought back plenty of memories of past touch tournaments where Mother Nature has turned ugly.2. Tight divisions across the park:Out of the 13 divisions played, nine of them were decided in the final match. This was a huge increase compared to the 2012 series where four games were decided by the last game. The only divisions not to remain alive after two matches were the women’s 30s, women’s 40s, men’s 35s and men’s 50s. Three of those divisions produced clean-sweep victories with New South Wales winning all the matches in women’s 30s, men’s 35s and men’s 50s. 3. Queensland looks good for the future:Queensland can salvage some pride from their State of Origin series loss and they can also look to the future with optimism. The maroons won both the under 20s divisions. It was a far contrast from two years ago when NSW clean swept the women and men’s 20s divisions. Queensland got revenge by winning the two divisions 2-1 respectively. With a lot of youngsters coming through the ranks and as well playing in the open divisions, Queensland looks really strong for the future. 4. Television production takes touch football to next level:Touch Football has been telecast plenty of times before but not like how it was during the State of Origin series. For the first time, the series was broadcast live and with commentators. Power Productions did a great job at streaming the State of Origin series online and will no doubt do a phenomenal job at producing a 90-minute for Fox Sports in early October.5. Don’t mess with the refs:Referees – you either love them or loathed them. Some players, coaches and spectators think they are blind, while others can’t stand them. So what happens when the referee strikes back? We certainly found out in the mixed open first match when referee Nathan Budge levelled Adam Pryde. In a hit that would have seen Budge face a lengthy spell on the sidelines if it was the NRL, his shoulder charge on Pryde floored the Queensland player. Who says referees don’t have a mean streak? 6. Mate against mate, best against best:Trans-Tasman is great, World Cup is even better, but nothing compares to State of Origin. The best touch football players in Australia representing their state and going head-to-head. It was fast, energetic, acrobatic, breath-taking and exhilarating. For two days, the best of Australian touch football lit up Sunshine Coast Stadium. State of Origin is a great concept and a must for the touch football calendar. The total number of certified early childhood institutions islandwide will shortly increase to 113, up from 17 a year ago.This, according to Education, Youth and Information Minister, Senator the Hon. Ruel Reid, reinforces the Government’s solid commitment to the early childhood sector’s development.He was speaking at the Jamaica Teachers’ Association’s (JTA) 54th Annual Conference at the Hilton Rose Hall Resort and Spa in Montego Bay, St. James, on Wednesday (August 22).Senator Reid said the Early Childhood Commission (ECC) has been crafting a strategy for the sector’s full transformation, which is slated to be rolled out when the 2018/19 academic year begins in September.He said the Ministry has been working to streamline and align the education system, noting that “our focus is to support the birth to three years old group through the early stimulation programme, (thereby) allowing our babies to be developmentally ready (by age) three.”Emphasising that the first 1,000 days are the most critical of a child’s development, Senator Reid said his Ministry will be partnering with the Ministries of Health, and Labour and Social Security, to undertake supporting engagements to be implemented by the ECC.These, he indicated, include developmental assessments to understand competencies in order to create the learning environment that fosters early stage learners’ development, while assuring that “we are fully committed to improving the quality of our early childhood institutions as we firmly believe in providing a good start at this level.”Meanwhile, Senator Reid advised that the 2018/19 Age Four Assessment will, for the second time, “allow us to identify, from very early, any development deficiencies to be corrected in our children.”He said the Ministry also continues to make significant strides in advancing its K-13 Strategy.Notable among its initiatives, the Minister pointed out, is the recently launched 0-3 Brain Builders Programme, which will benefit over 126 institutions. The programme is expected to be rolled out in the first 17 schools in September.In the meantime, Senator Reid said primary level student preparations for transition to secondary education continues to trend in the right direction.He noted that the outcome of the Grade Six Achievement Test’s (GSAT) final sitting earlier this year showed improvements in four of the five subject areas – Science, Social Studies, Communication Task and Language Arts.This, he added, resulted in “100 per cent of our students (being) placed in seven-year high schools.”“The Ministry was able to achieve this as a result of the provision of additional classrooms to a number of our schools and the upgrade to full seven-year high schools of Nain, New Forrest, Aberdeen and Perth Town Academy,” Senator Reid further pointed out.He also said candidates who entered for 35 subjects in the 2017/18 Caribbean Advanced Proficiency Examination (CAPE) came out with satisfactory results.“There was an overall increase by 0.2 percentage point over the previous year with a 91.2 per cent receiving acceptable grades. As was the case last year, there was improved performance in 23 subject areas,” the Minister stated.Additionally, he said 30,343 or 88.9 per cent of the 34,139 students who sat the 2017/18 Caribbean Secondary Education Certificate (CSEC) examination obtained acceptable grades.Senator Reid noted that Mathematics and English Language recorded passes of 57.8 and 75.4 per cent, respectively.This, he pointed out, is a 7.6 and 4.6 per cent increase, respectively. The spotlight was on the 13 feet and 1 inch of All-American candidate centers in the Ohio State-Michigan State women’s basketball game Saturday, but 5-foot 7-inch Samantha Prahalis stole the show in the Buckeyes’ 65-62 win.Allyssa DeHaan, at 6 feet 9 inches, and Jantel Lavender, at 6 feet 4 inches, didn’t have much of a battle in the paint like anticipated. Prahalis had a huge game, leading the Buckeyes to victory with a career-high 32 points — 16 in each half — and five assists. She never had a cold spell in the game, scoring the team’s first seven points and seven of its last nine.“When I saw that [the shots] were falling, I just kept shooting,” Prahalis said. Although their matchup wasn’t the highlight of the game, Lavender and DeHaan each played a major role.DeHaan’s size allowed her to take away Lavender’s ability to post-up and made every OSU player think twice before attempting a shot in the key. She had three blocks in the game along with 12 points.Lavender had a more profound impact on the stat sheet than DeHaan did. Lavender had 20 points and 13 rebounds — her ninth double-double of the season.She had a slow first half, however, succumbing to MSU’s defensive game plan to keep her out of the paint on both ends, but she came alive in the second half, using her speed to get around DeHaan and not allow her to challenge her shots.“My focus is trying to get to the basket,” Lavender said. “The taller you get, the slower you get, no matter how athletic you are. I just need to get her off her feet and drive her to the basket.”Both Lavender and DeHaan are largely considered All-American candidates this year and have been since before the season began. This game may have vaulted Prahalis into the same arena.Prahalis has been ranked in the top 10 in assists most of the season and is currently ranked second with 8.2 per game, behind only Gonzaga’s Courtney Vandersloot, an All-American Honorable Mention last season.“We have two great players [in Lavender and Prahalis],” coach Jim Foster said. “They are very competitive, they want to win games and they’re going to put their responsibility into the game.”Prahalis has now been the difference for OSU in the last two games. She hit the game-winning shot against Michigan Jan. 3 and Saturday she scored nearly half of OSU’s points against MSU. “I think she’s an amazing player,” Lavender said. “She can shoot, she can drive, she can pass … she can do it all.”
